Terms of Service

Welcome to ImgPak ("ImgPak", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the ImgPak iOS application and related services (the "Service"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

ImgPak is an image compression application that helps you reduce the file size of images while preserving visual quality. Images you submit are uploaded to our processing servers, compressed, and the output is returned to your device. Original and output files are deleted from our servers immediately after the compression task completes and are never retained for any other purpose.

2. Eligibility

You must be at least 16 years old to use the Service. By using ImgPak you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. The Service is not directed to children under 16, and we do not knowingly permit such use.

3. Your Account

ImgPak uses Sign in with Apple as its sole authentication method. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account. You agree to notify us promptly at support@gleamflux.com of any unauthorized access.

4. Free Usage and Quota

Free users receive 5 compression credits on their first day of registration and 1 compression credit per day thereafter. Unused credits do not roll over. We may adjust free-tier limits at any time with reasonable notice.

5. Subscriptions and In-App Purchases

Paid features are sold exclusively through Apple In-App Purchase (IAP). By subscribing, you authorize Apple to charge the payment method associated with your Apple ID in accordance with the pricing displayed in the App Store at purchase.

• Auto-renewal: Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You may cancel at any time in your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period.
• Refunds: All refund requests are handled exclusively by Apple through the App Store refund process. ImgPak does not process refunds directly and does not offer supplementary refund policies.
• Price changes: We may change subscription prices; changes take effect for subsequent billing periods and will be communicated as required by Apple's policies.

6. Your Content

You retain all rights in the images you submit ("Your Content"). You grant us a limited, temporary, worldwide, royalty-free license to process Your Content solely for the purpose of delivering the compression service to you. This license terminates automatically the moment the compression task completes and the files are deleted. We do not use Your Content to train models, for analytics, for advertising, or for any other purpose.

You represent and warrant that you own or have all necessary rights to Your Content and that its processing does not violate any law or third-party right.

7. Acceptable Use

You agree not to use the Service to:

• upload content that is illegal, infringing, defamatory, obscene, or depicts child sexual abuse material (CSAM);
• circumvent quota, security, or authentication mechanisms, or attempt to reverse-engineer the Service;
• interfere with or disrupt the Service, its servers, or networks;
• use automated means (bots, scrapers) to access the Service;
• resell, sublicense, or commercially redistribute the Service without our written consent.

8. Intellectual Property

The Service, including its software, design, trademarks, and all related intellectual property, is owned by GLEAMFLUX LTD and its licensors. Except for the limited right to use the Service under these Terms, no rights are granted to you.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY COMPRESSION WILL PRODUCE A SPECIFIC RESULT. YOU ARE RESPONSIBLE FOR MAINTAINING YOUR OWN BACKUPS OF YOUR ORIGINAL FILES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLEAMFLUX LTD, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US VIA APPLE IAP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD 50. NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (INCLUDING THE UK CONSUMER RIGHTS ACT 2015 AND EU CONSUMER PROTECTION LAW).

11. Indemnification

You agree to indemnify and hold harmless GLEAMFLUX LTD from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your violation of these Terms, or your violation of any law or third-party right.

12. Termination and Account Deletion

You may stop using the Service at any time. To delete your account and associated data, open the ImgPak app and navigate to User Profile → Delete Account. Deletion is irreversible.

We may suspend or terminate your access to the Service if you materially breach these Terms, or if required by law, Apple's guidelines, or to protect the security or integrity of the Service.

13. Apple-Specific Terms

You acknowledge that these Terms are between you and GLEAMFLUX LTD, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. In the event of a conflict between these Terms and Apple's Media Services Terms, Apple's Licensed Application End User License Agreement (EULA) provisions regarding third-party applications shall apply. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Subject to mandatory consumer-protection laws in your country of residence (which may grant you additional rights and the ability to bring proceedings in your local courts), the courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated in-app or via the email associated with your account before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
